Terms of Service
1. Acceptance of Terms
By purchasing, downloading, installing, or using Pithecus ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Software. These Terms form a binding legal agreement between you and Sam Bousounis trading as Pithecus ("we", "us", "our"), based in Victoria, Australia.
2. Licence Grant
Upon purchase you are granted a non-exclusive, non-transferable, personal licence to install and use Pithecus on up to two (2) computers that you own or control. This licence is for personal or internal business use only.
- You may not sell, sublicence, rent, lease, or otherwise transfer the Software or your licence to any third party.
- You may not redistribute, share, upload, or publish the installer files (DMG, ZIP, or any derivative) publicly or privately to people who have not purchased a licence.
- You may not reverse-engineer, decompile, or disassemble the Software except to the extent permitted by applicable law.
- One purchase = one person. If a colleague wants to use Pithecus, they need their own licence.
3. AI-Generated Content — Hallucination Disclaimer
Pithecus uses local artificial intelligence language models ("AI Models") to generate responses, summaries, and insights. You expressly acknowledge and agree that:
- AI outputs may be inaccurate. Language models can produce responses that are false, misleading, incomplete, or nonsensical. You must not rely on AI-generated content for medical, legal, financial, safety-critical, or any other decisions without independent verification from a qualified professional.
- We do not guarantee accuracy. We make no representation or warranty that any AI output is correct, current, or fit for any particular purpose.
- You are responsible for verifying outputs. Any action you take based on AI-generated content is taken at your own risk and judgment.
- The AI does not give professional advice. Nothing the AI says constitutes medical, psychological, legal, financial, or any other professional advice.
4. Your Data & Privacy
Pithecus is a local-first application. All your data — memories, conversations, documents, and personal information — is stored exclusively on your own computer. We do not collect, transmit, access, or store any of your personal data on our servers. See our Privacy Policy for full details.
5. Purchases & Refunds
Pithecus is sold as a one-time purchase. Payments are processed by Stripe. Under the Australian Consumer Law ("ACL"), you may be entitled to a remedy if the Software has a major failure. Outside of ACL rights, we offer a 14-day money-back guarantee — if the Software does not work on your computer and we cannot resolve the issue, contact us within 14 days of purchase for a full refund.
6. Updates & Support
We aim to provide updates and bug fixes on a best-efforts basis. We do not guarantee any specific update schedule, feature additions, or continued support for older operating system versions.
7. Disclaimer of Warranties
To the maximum extent permitted by law, the Software is provided "as is" without warranty of any kind, express or implied. Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or relating to the Software or these Terms shall not exceed the amount you paid for your licence.
9. Termination
Your licence terminates automatically if you breach any of these Terms. Upon termination, you must cease using the Software and delete all copies in your possession.
10. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
11. Changes to These Terms
We may update these Terms from time to time. The current version will always be available at pithecus.com.au/terms. Continued use of the Software after changes are posted constitutes your acceptance of the updated Terms.
